Public liability and employers' liability claims

Public liability

Public liability (PL) covers third parties, such as students, members of the public, and visitors, for damage to person or property as a result of negligence on the part of the University. Our own employees are not covered as they are covered under the employers' liability policy.

The PL policy indemnifies the University for compensation awarded for injury or damage to third parties due to proven negligence in our business operation. However, any fines or punitive damages laid down following a criminal or HSE prosecution would not be covered - it is not possible to obtain insurance cover for fines or penalties.

Employers' liability

Employers are responsible for the health and safety of their employees while they are at work and employers' liability (EL) is a legal requirement under UK law. Our EL policy indemnifies Southampton Solent University for the cost of compensation awarded to employees, resulting from the University's proven negligence.

Liability claims

All liability claims are managed via the insurance office and handled by the University's insurer. Correspondence from a claimant's legal representatives should never be responded to directly and must be forwarded to the insurance office immediately.

If you have reason to believe that a claim may be made in the future against the University, please inform the insurance office at as soon as possible.

Ministry of Justice reforms

In 2013 Ministry of Justice (MOJ) reforms introduced changes to the way that liability claims are handled. The outcome of these changes means we have a reduced period of 30 working days to investigate public liability claims and employer liability claims.

If we receive a claim notification form for injury accidents these need to be acknowledged within one working day.

As such it is very important to get in touch with the insurance office at as soon as possible and to cooperate with any investigation as requested.
